Terms of Service

These Terms of Service (hereinafter referred to as the "Terms") set forth the conditions for using WidgeGo (hereinafter referred to as the "App"). Users are requested to use the App in accordance with these Terms.

Article 1 (Applicability and Contractual Subject)

These Terms apply to all relationships related to the use of the App between the User and the developer of the App (hereinafter referred to as the "Developer").
The User acknowledges and agrees that these Terms are concluded solely between the User and the Developer, and not with Apple Inc. and its subsidiaries (hereinafter collectively referred to as "Apple"). The Developer, not Apple, is solely responsible for the App and its content.

Article 2 (Scope of License)

The Developer grants the User a non-transferable, non-exclusive license to use the App. The User may use the App only on Apple-branded products that the User owns or controls and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with the User via Family Sharing or volume purchasing.

Article 3 (Provision and Modification of the App)

The Developer may change, add, or discontinue the content, specifications, or provision of the App without prior notice. The Developer shall not be liable for any damages incurred by the User as a result of such changes.

Article 4 (Premium Plan Subscription)

The App offers a paid "Premium Plan (Subscription)" that provides additional features and removes advertisements.

  • For details on the contents, features provided, and usage fees of the Premium Plan, the latest information stated on the purchase screen within the App will apply.
  • Payment will be charged to the User's Apple ID account upon confirmation of purchase.
  • Subscriptions will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Users can manage and cancel their subscriptions from the Apple ID account settings in the "Settings" app on their iOS device.

Article 5 (Maintenance and Support)

The Developer is solely responsible for providing any maintenance and support services with respect to the App. The User and the Developer acknowledge and agree that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Article 6 (Warranty and Disclaimer)

The Developer does not expressly or impliedly warrant that the App is free from de facto or legal defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc., errors or bugs, infringement of rights, etc.).
In the event of any failure of the App to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price for the App to the User. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility.
The Developer assumes no responsibility for any disadvantages due to the inability to scan barcodes or QR codes within the App. Please use it at your own risk.

Article 7 (Product Claims)

The User and the Developer acknowledge that the Developer, not Apple, is responsible for addressing any claims of the User or any third party relating to the App or the User's possession and/or use of the App, including, but not limited to:
(i) product liability claims;
(ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and
(iii) claims arising under consumer protection, privacy, or similar legislation (including in connection with the App's use of the HealthKit and HomeKit frameworks).

Article 8 (Intellectual Property Rights)

The User and the Developer acknowledge that, in the event of any third-party claim that the App or the User's possession and use of the App infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

Article 9 (Legal Compliance)

The User represents and warrants that (i) he/she is not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) he/she is not listed on any U.S. Government list of prohibited or restricted parties.

Article 10 (Prohibited Acts)

In using the App, Users must not engage in the following acts.

  • Acts that violate laws and regulations or public order and morals
  • Acts related to criminal activities
  • Acts that destroy or interfere with the functions of the App's server or network
  • Acts of collecting or accumulating personal information concerning other Users
  • Acts of impersonating other Users
  • Other acts deemed inappropriate by the Developer

Article 11 (Third-Party Terms of Agreement)

The User must comply with applicable third-party terms of agreement when using the App (e.g., wireless data service agreements).

Article 12 (Third-Party Beneficiary)

The User and the Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon the User's acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against the User as a third-party beneficiary thereof.

Article 13 (Governing Law, Jurisdiction and Prevailing Language)

The interpretation of these Terms shall be governed by the laws of Japan.
In the event of any dispute regarding the App, the Tokyo District Court shall have exclusive jurisdiction in the first instance.
Furthermore, these Terms are drawn up in Japanese. In the event that translated versions of these Terms in other languages exist and there is a conflict or discrepancy between the Japanese original and any translation, the Japanese original shall prevail at all times.

Article 14 (Modification of Terms)

The Developer may change these Terms at any time without notifying the User if deemed necessary. The modified Terms of Service will become effective from the time they are posted on this page or within the App.
